Using Stoptimizer
Stoptimizer helps users enter stops, optimize routes, estimate travel order, and launch navigation. You are responsible for your use of the Services and for complying with all traffic, safety, employment, delivery, privacy, and other laws that apply to you.
You must be old enough to form a binding contract in your jurisdiction. If you use Stoptimizer on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.
Accounts and security
You agree to provide accurate account information and keep it up to date. You are responsible for protecting your login credentials and for activity that occurs under your account. Notify us promptly if you believe your account has been compromised.
Subscriptions, billing, and refunds
Stoptimizer may offer a free tier and paid subscription features. Current website pricing is $9.99 per month unless a different price is shown at checkout. Taxes may apply.
Subscriptions purchased through Apple App Store, Google Play, or another app distributor are billed, renewed, canceled, and refunded under that distributor's rules. You can manage or cancel those subscriptions through the account settings provided by the app distributor. Deleting the app does not automatically cancel a subscription.
Mobile app license
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use Stoptimizer on devices you own or control for personal or internal business route planning.
You may not copy, modify, reverse engineer, decompile, disassemble, attempt to derive source code from, rent, lease, sell, sublicense, redistribute, or create competing products from Stoptimizer except where applicable law expressly allows such activity.
All rights not expressly granted are reserved by Nocturnal Devs and its licensors.
Apple App Store and other app distributors
If you download Stoptimizer from Apple App Store, you acknowledge that these Terms are between you and Nocturnal Devs, not Apple. Apple is not responsible for Stoptimizer or its content. Your license is limited to use on Apple-branded products you own or control and as permitted by Apple's App Store usage rules, including applicable Family Sharing or volume purchase rules.
Nocturnal Devs, not Apple, is responsible for providing maintenance and support for Stoptimizer as described in these Terms or required by law. If Stoptimizer fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, under its policies. To the fullest extent permitted by law, Apple has no other warranty obligation for Stoptimizer.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not listed on any U.S. government restricted party list. You must comply with applicable third-party agreements when using Stoptimizer, including wireless data service agreements.
Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. For Apple-distributed apps, Apple's Standard Licensed Application End User License Agreement applies to the extent these Terms do not provide a separate valid end user license agreement. Google Play and other distributors may also be third-party beneficiaries where their rules require it.
Routes, maps, and safety
Stoptimizer provides route optimization and location-related information for planning convenience. Maps, traffic, geocoding, location, distance, and travel-time data may be inaccurate, delayed, incomplete, unavailable, or affected by third-party services.
Do not rely on Stoptimizer in situations where inaccurate route or location information could lead to death, personal injury, property damage, environmental damage, or legal violations. Always obey traffic laws, posted signs, road conditions, workplace rules, and your own judgment. Do not interact with the app while driving unless it is safe and lawful to do so.
Your content and route data
You retain your rights in addresses, notes, route details, feedback, and other content you submit. You grant Stoptimizer a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, transmit, and use that content only as needed to operate, secure, support, and improve the Services and as otherwise described in our Privacy Policy.
You are responsible for ensuring that you have the rights and permissions needed to enter or upload any information, including customer addresses, driver information, delivery notes, or business data.
Acceptable use
You agree not to misuse Stoptimizer. You may not:
- Use the Services for unlawful, unsafe, deceptive, infringing, or abusive activity.
- Interfere with, overload, probe, scan, or disrupt the Services or related systems.
- Use automated scraping, bots, or bulk extraction except with our written permission.
- Attempt to bypass authentication, authorization, subscription limits, security controls, or rate limits.
- Upload malware or content that violates someone else's rights.
- Use Stoptimizer to build or train a competing route optimization product without our written permission.
Third-party services
Stoptimizer may link to or rely on third-party services, including app stores, maps, routing providers, analytics, payment processors, support tools, wireless carriers, and websites. We do not control third-party services and are not responsible for their content, availability, accuracy, practices, or terms.
Disclaimers and limitation of liability
To the fullest extent permitted by law, Stoptimizer is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
To the fullest extent permitted by law, Nocturnal Devs and its owners, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, route delays, delivery failures, or safety incidents arising out of or related to your use of Stoptimizer.
Where liability cannot be excluded, our total liability for any claim will be limited to the greater of the amount you paid to Stoptimizer in the one month before the event giving rise to the claim or CAD $50, unless applicable law requires otherwise.
Changes, suspension, and termination
We may modify, suspend, or discontinue parts of Stoptimizer at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay fees, or used the Services unlawfully.
We may update these Terms from time to time. When we make material changes, we will update the effective date and provide additional notice where required. Continued use of Stoptimizer after changes become effective means you accept the updated Terms.
